If a loved one lost their home to foreclosure and has since passed away, their surplus funds may still be available — but it’s up to the heirs to claim them. In Florida, the probate and foreclosure systems often overlap, creating confusion about how and when heirs can recover these funds.
“Many heirs never file a claim because they think it’s too late or don’t know the funds exist,” said Monica Fields, a probate liaison in Broward County.
Surplus funds can still be claimed by qualified heirs through court affidavits, probate filings, or attorney-led recovery.
