Under Florida Statute 45.032, homeowners have the legal right to claim surplus funds from a foreclosure sale if the property sells for more than the total owed on liens and judgments. But these funds don’t automatically reach the homeowner — a formal claim must be filed in court.
“People assume the court will just send them a check. That’s rarely the case,” said foreclosure legal consultant Denise Carter. “The claim process is time-sensitive and requires accurate documentation.”
Experts urge homeowners to act before funds are redirected to lienholders or the state.
